Grae Elite Coaching Terms & Conditions

Welcome to Grae Elite Coaching. By using our website, services, and programs, you agree to the following terms and conditions. Please review them carefully.

1. Services Provided

Grae Elite Coaching ("GEC") provides the following services, delivered in person and/or online:

• Face-to-Face Personal Training

• Online Coaching

• Nutrition & Meal Plans

• Pre & Post Natal Plans

• Hyrox Training

• Marathon Training Plans

• Couples Coaching

Services may involve the use of intake and screening forms, progress tracking, and third-party platforms including the Trainerize app.

2. Eligibility

Clients must be 18 years or older to enter into this agreement independently. Clients under 18 may participate only with the consent of a parent or legal guardian, who must sign this agreement on the minor's behalf, assumes responsibility for payment, and confirms disclosure of any relevant medical history.

3. Client Responsibilities

The Client agrees to:

• Consult a healthcare provider and obtain medical clearance before beginning or continuing any fitness or nutrition program, particularly where a pre-existing condition, injury, pregnancy, or postnatal recovery is involved.

• Provide accurate, complete, and up-to-date information on all screening, check-in, and enquiry forms, and to promptly notify their coach of any change in health status.

• Follow all safety instructions provided by their coach and disclose any pain, discomfort, or health concerns as they arise, before and during sessions.

4. Payments & Cancellations

• All fees are payable as specified upon registration or scheduling.

• Individual sessions may be cancelled or rescheduled with at least 24 hours' written notice. Cancellations made with less than 24 hours' notice will be charged in full and are non-refundable. 

• Refunds are governed by Sections 4 and 5.5 of the Service Agreement: coaching services are billed on a subscription basis, and no refunds are provided for unused weeks, early termination, or non-participation, except within any agreed cooling-off period.

5. Limitation of Liability

Grae Elite Coaching and its coaches are not liable for injuries or adverse outcomes arising from your participation in our services, except to the extent caused by our negligence. This exclusion does not apply where you have failed to follow provided instructions and warnings, or where you have withheld or misrepresented relevant medical information.

Our advice, programming, and nutrition guidance are provided to support your goals and do not replace professional medical advice, diagnosis, or treatment. You should consult a healthcare provider before beginning or continuing any program, particularly where a pre-existing condition, injury, pregnancy, or postnatal recovery is involved.

Nothing in this clause excludes, restricts, or modifies any consumer guarantee or right you have under the Australian Consumer Law that cannot lawfully be excluded.

6. Intellectual Property

All training programs, nutrition plans, resources, and materials provided by Grae Elite Coaching remain the intellectual property of Grae Elite Coaching, regardless of format or delivery method. These materials are provided for your personal use only and may not be copied, reproduced, shared, or distributed, in whole or in part, without our prior written consent.

7. Data Privacy

We collect, use, and store your personal information in accordance with our Privacy Policy, set out above. By agreeing to these Terms, you acknowledge that you have read and understood our Privacy Policy.

8. Changes to Terms

We reserve the right to update these Terms from time to time to reflect changes in our services, practices, or legal requirements. The updated Terms will be posted on our website with a new effective date. We encourage you to review these Terms periodically. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the exclusive jurisdiction of its courts. In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith discussion and, if unresolved, mediation, before pursuing formal legal action.
